Joyfactor GmbH operates an international video-on-demand (VOD) platform offering professionally produced and contractually licensed third-party content.
We are committed to respecting intellectual property rights and require all content partners to provide legally valid licenses and documented rights clearance.
We maintain a strict zero-tolerance policy for copyright infringement.
This policy is intended to comply with:
• Austrian Copyright Act (UrhG)
• Austrian Civil Code (ABGB)
• EU copyright framework
• EU E-Commerce Directive
• U.S. Digital Millennium Copyright Act (DMCA), where applicable
2. Licensed Content Model
All content made available on our platform is provided under contractual agreements with verified content partners.
Each content provider is contractually required to:
• Represent and warrant full ownership or licensing rights
• Confirm documented consent of all performers
• Indemnify Joyfactor GmbH against third-party claims
• Provide proof of rights upon request
We do not allow public uploads or user-generated content.
3. Reporting Intellectual Property Infringement
If you believe that content available on our platform infringes your copyright or other intellectual property rights, please submit a written notice including:
1. Identification of the copyrighted work.
2. Exact URL or title of the allegedly infringing content.
3. Description of the claimed infringement.
4. Proof of ownership or authorization to act on behalf of the rights holder.
5. Your full legal name and contact details.
6. A good faith statement that the use is unauthorized.
7. A declaration that the information is accurate.
8. Your physical or electronic signature.
Incomplete notices may delay processing.
4. Review Procedure
Upon receipt of a substantiated complaint:
• We conduct an internal legal review without undue delay.
• The respective content provider is contacted immediately.
• The content may be temporarily disabled during investigation.
• Documentary proof of rights may be requested.
If infringement is confirmed or cannot be sufficiently refuted, the content will be permanently removed.
5. Counter-Statement
If a content provider disputes the allegation, they must provide:
• Documentary proof of licensing or ownership
• Written legal statement
• Indemnification confirmation
Where appropriate, content may be reinstated if lawful rights are established.
6. Repeat Violations
Repeated intellectual property violations by a content partner may result in:
• Immediate suspension
• Contract termination
• Legal action
7. Misuse of Complaint Procedure
Knowingly submitting false or misleading infringement claims may result in legal liability under applicable laws.
8. Governing Law
This policy is governed by Austrian law.
